These Terms of Service govern access to nsidejokes.com and purchases from Nside Jokes LLC. By using the store or placing an order, you agree to these terms and the policies incorporated by reference. If you do not agree, do not use the store.

Eligibility and Store Use

You must be legally able to enter a binding agreement in your location to place an order. You may not use the store for unlawful, fraudulent, abusive, or unauthorized purposes. The adult-only section is limited to visitors who are at least 18 years old or the age of majority where they live, whichever is higher.

Products and Descriptions

We try to display products, colors, dimensions, materials, and availability accurately. Screen settings, production methods, garment batches, embroidery, printing, handmade work, and packaging can create reasonable differences. We may correct errors, update information, limit quantities, modify products, or discontinue products without prior notice. A listing does not guarantee availability.

Orders and Acceptance

An order confirmation acknowledges that we received your order; it does not guarantee acceptance. We may refuse, limit, or cancel an order for suspected fraud, pricing or inventory errors, prohibited content, supplier limitations, payment problems, shipping restrictions, or other legitimate business reasons. If we cancel after payment, we will refund the cancelled amount to the original payment method.

Prices Payments and Taxes

Prices are shown in the currency displayed at checkout and may change without notice. You authorize the store and its payment providers to charge the order total, including shipping and applicable taxes. You are responsible for accurate billing information and any duties, taxes, or fees not collected at checkout, unless the law requires otherwise.

Custom Orders and Proof Approval

Custom work may require a design fee, deposit, minimum quantity, proof approval, or separate written quote. You must review all names, spelling, dates, measurements, colors, placement, quantity, and artwork before approval. Approval authorizes production. Changes requested after approval may require a new fee, revised timeline, or new order. Custom and personalized products are governed by the final-sale terms in the Return and Refund Policy.

Customer Content and Permissions

You retain ownership of content you submit. You grant Nside Jokes and its production partners a limited, nonexclusive right to copy, adapt, display, and use that content only as needed to evaluate the request, prepare proofs, produce and deliver the order, provide support, prevent fraud, enforce these terms, and maintain required records. We will not use a private custom design in public marketing without separate permission.

You represent that you own or have permission to use all submitted names, images, logos, trademarks, copyrighted works, likenesses, and other content. You are responsible for claims arising from content you submit. We may reject content that appears unlawful, infringing, hateful, threatening, defamatory, exploitative, deceptive, or otherwise inconsistent with our business standards.

Nside Jokes Intellectual Property

The store and its original content, including the Nside Jokes name, logos, slogans, product concepts, artwork, graphics, characters, photographs, videos, text, layout, and other brand materials, are owned by or licensed to Nside Jokes LLC and are protected by applicable intellectual property laws. Except for ordinary personal use of the store, no license is granted. You may not reproduce, modify, sell, distribute, scrape, train systems on, or commercially exploit protected store content without written permission.

Reviews and Public Submissions

If you submit a review, testimonial, tag, public comment, or other content intended for public display, you grant Nside Jokes a nonexclusive, worldwide, royalty-free license to display, reproduce, adapt for formatting, and share that content in connection with the business, subject to applicable law. You confirm that the submission is truthful, based on your experience, and does not violate another person's rights. We may moderate content but are not obligated to publish every submission.

Shipping and Delivery

Processing and delivery estimates are not guarantees unless we expressly agree otherwise in writing. Delays may result from customization, inventory, carriers, weather, events outside our control, or incomplete customer information. If we cannot ship within the promised period, we will provide any notice, consent option, cancellation, or refund required by applicable law. Risk of loss transfers as provided by applicable law and the shipping terms presented at checkout.

Returns Refunds and Store Policies

The Return and Refund Policy, Privacy Policy, Shipping Policy, and any product-specific terms displayed before purchase are incorporated into these terms. If product-specific terms conflict with these general terms, the more specific terms control for that product to the extent permitted by law.

Prohibited Conduct

·         Use the store to break a law, infringe rights, impersonate another person, or submit false information

·         Transmit malware, harmful code, automated attacks, scraping tools, or activity that disrupts the store

·         Attempt unauthorized access to accounts, systems, checkout, discounts, customer information, or security features

·         Use store content, designs, or branding to create counterfeit, confusingly similar, or unauthorized products

·         Harass, threaten, exploit, discriminate against, or harm another person through the store or submitted content

Third Party Services

Shopify, payment providers, carriers, social platforms, and other third parties may provide parts of the store experience. Their services and policies may apply separately. Nside Jokes is not responsible for a third party's independent acts, content, availability, or privacy practices, except to the extent applicable law provides otherwise.

Disclaimer of Warranties

To the fullest extent permitted by law, the store and its content are provided on an as-is and as-available basis. Nside Jokes disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement to the extent those warranties may legally be disclaimed. This section does not limit an express written product promise or any warranty or consumer right that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by law, Nside Jokes LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from store use or a purchase. To the fullest extent permitted by law, total liability for a claim will not exceed the amount paid for the product or order giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nside Jokes LLC from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the store, your breach of these terms, or content you submit without the required rights or permissions.

Governing Law and Disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be brought in a state or federal court with lawful jurisdiction in the Texas county where Nside Jokes LLC maintains its principal place of business, unless applicable consumer law requires another forum. Before filing a claim, contact us through the store Contact page and allow 30 days for a good-faith attempt to resolve the dispute. Nothing in this section removes a right that cannot legally be waived.

Termination

We may suspend or terminate access to the store for conduct that violates these terms, threatens security, harms another person, or exposes Nside Jokes to legal or operational risk. Provisions that by their nature should survive termination remain effective, including payment obligations, intellectual property, disclaimers, liability limits, indemnification, and dispute terms.

Changes to These Terms

We may update these terms by posting a revised version with a new effective date. Changes apply prospectively unless the law permits otherwise. Continued use after the effective date means you accept the updated terms.

Severability and Entire Agreement

If a court finds part of these terms unenforceable, the remaining terms remain effective to the fullest extent allowed by law. These terms and the incorporated store policies form the agreement between you and Nside Jokes regarding the store and replace prior discussions about the same subject, except for a separate written agreement signed by an authorized representative of Nside Jokes.
